I've never seen two people with the same avatar before. I seem to recall that when selecting an avatar I couldn't take those that other's had taken, so how does this work?

Yours is not the only duplication I've seen. I also thought only user per avatar at a time.

The forum can't actually recognize duplicate images; users can upload the image manually and use anything they want whether or not it is in use. The best the forum can do is limit avatars selected from the gallery to one user, and the users in the OP did not both select the same avatar from the gallery.

The system will only allow the same avatar to be selected once from the gallery, but there is nothing preventing the user from getting the same image from another source.

In this case, though, as the other user is inactive, I don't think it's a big issue.

I don't think a different source would even be required; they should be able to "copy image location" and paste it directly in the box below.

Even if images were scanned to ensure the same image wasn't used twice, all one has to do is change a single pixel to a slightly different shade, and a computer wouldn't recognize it as the same anymore.

Is it against the rules to use the same avatar as another user? I thought i saw something in the past about that not being allowed due to the potential for impersonation or somesuch, since people easily identify some users by their avatars

If you are using SHA-1 or MD5 hashing of the image file yes. But complex profiling algorithms (given that the image sizes are small) can be applied to get a likelyhood by using many say approaches (like desaturation/ black-white comparison). Though I still don't find the whole thing necessary

Given that only usernames are identified as unique, and are the "handle" of the user, not the image itself, since that is succeptible to change (by the user that is) I don't see any impersonation occuring, perhaps confusion. But i think impersonation only apply in the chatroom where a user can effectively change to the unique handle of another. (if not protected that is)

It's possible, easy to do, contact them if yours is from gallery so they are aware of that and may change it if they will.
If two users use the same custom avatar... it's just to you two guys also to decide what to do about it.

Sure it's possible for computer to detect similar images (avatars) and when selecting yours make a note that it might be in use already, but some people change avatars often so you might use their previous by which people might still know them etc.
Unsolvable unless you bring some strict rules and checking.

It is not against the rules to use the same avatar as another user.

It is against the rules to say, take another user's avatar, modify it so that it is insulting, then display it as your avatar.

It's fairly easy to get a custom avatar anyway. If you don't want to get cloned, stay away from the image bank.
