Does anyone else follow the situation of spyware generators who attack anti-spyware writers?

The 9th circuit posted the oral argument today in zango v kaspersky

Zango's lawyer starts with an "argument" that if all vendors did what kaspersky does, Zango would be out of business.
Seems to me like that's a great case for why kaspersky should win, hands down.

Eric Goldman has some pretty retrograde ideas about spyware generators' responsibility for hiring dirty affiliate networks, but, still... has collected some nice links about the zango attacks, here:

I remember just getting online as a kid - wading through the jungle of pop-ups and depending on adware vessels like Kazaa and Limewire for all media. Those were NOT the days.
